The prosecution of this case is dismissed.
Reasons
1. On August 9, 2015, the Defendant, at around 11:40, assaulted the victim D, who emitted from the above restaurant in front of the restaurant located in the Busan Young-gu, Busan Metropolitan City, with the hand floor of the victim, at the time of a hand-to-face-to-face-to-face bing the victim, without any justifiable reason.
2. Determination
(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.
(c) Declaration of non-declaration of punishment: Agreements submitted on October 12, 2015;
(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
