가. 위 챗 대화명 D 등 성명 불상자들은 속칭 ‘ 보이스 피 싱’ 범죄를 하기 위하여 유인책, 계좌 및 현금카드 모집 책, 인출 관리 책, 인출 책 등 여러 단계를 조직하고, 유인책에 속하는 자들은 피해자에게 무작위로 전화를 걸어 수사기관, 금융기관 등을 사칭하며 피해자가 금융기관에 예금한 돈이 불법적으로 인출된 위험이 있어 보안조치가 필요한 것처럼 속여 피해자로 하여금 성명 불상자들이 미리 모집한 계좌로 돈을 이체하도록 하면, 인출 관리 책은 인 출자들에게 지시하여 피해 금을 인출하여 전달 받는 방법으로 돈을 편취하기로 하였다.

피고인들은 2017. 8. 경 보이스 피 싱 조직 총책 인 위 챗 대화명 D를 사용하는 자로부터 제 3자 명의 체크카드와 그 계좌로 입금된 피해 금을 인출하여 전달해 주면 돈을 주겠다는 제안을 받고 이에 응하여 위 ‘D’ 의 지시에 따라 피고인들이 제 3자 명의 체크카드와 그 계좌에 입금된 현금을 인출하여 성명 불상자에게 건네주는 역할을 하기로 하였다.
