1. The Defendant’s disposition of suspension from office for three months against the Plaintiff on September 10, 2013 is revoked.
2. The costs of the lawsuit are assessed against the defendant.
1. Details of the disposition;
A. On February 16, 1987, the Plaintiff was promoted to the professor on April 1, 1998 after being newly appointed as a national ethics education and full-time lecturer at B University.
B. On September 5, 2013, the General Disciplinary Committee of B University (hereinafter “instant Disciplinary Committee”) decided against the Plaintiff for three months of suspension from office on the grounds that the Plaintiff committed an act detrimental to the dignity stipulated in Article 63 of the State Public Officials Act on the following grounds. Accordingly, the Defendant was subject to three months of suspension from office against the Plaintiff on September 10, 2013.
(hereinafter referred to as “instant disposition”). - A.I.D.’ published by the Plaintiff at the F Academic Games held around October 201 by Ethical societies (hereinafter “H”) plagiarism. < Amended by Presidential Decree No. 23264, Dec. 1, 201; Presidential Decree No. 25035, Dec. 2, 2011>
(hereinafter “Grounds for Disposition 1”). (2) Considering that the thesis published by H is a private letter stating that “to be audited by the Plaintiff’s guidance,” the Plaintiff’s publication of “D” as an independent author constitutes an act of “an act of indicating the author’s author’s identity” without justifiable grounds to a person who has contributed or contributed to the research content or result provided for in Article 4(1)3 and 4 of the Guidelines for Securing Research Ethics.
(hereinafter “Grounds for Second Disposition”). (3) As a result of comparison of 10 copies of the paper drawn up by the Plaintiff from 2007 to 2011, the Plaintiff violated the provision that “Researchists shall use their research findings that have not been published before the preparation of the research paper and publish and publish the works identical or substantially similar to the previous research results and endeavor not to use them for their own research results or for the purpose of performance.”
