강제추행
The prosecution of this case is dismissed.
1. On April 21, 2013, the Defendant, at around 02:30, committed an indecent act by compulsion against the victim D (year 21, female) who visited “Cata club” located in Songpa-gu Seoul, Songpa-gu, Seoul, in drinking alcohol, and visited the customer, on two occasions.
2. The facts charged of this case are crimes falling under Article 298 of the Criminal Act, which can be prosecuted only when the victim files a complaint under Article 306 of the Criminal Act. According to the letter of withdrawal of the complaint submitted on May 13, 2013, the victim's withdrawal of the complaint against the defendant is recognized. Thus, it is so decided as per Disposition pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.
