1. The Plaintiff (Counterclaim Defendant) indicated the attached Form 1, 14, and 14, among the land size of CJ 464 square meters in Gyeongnam-do, Gyeongnam-do to the Defendant (Counterclaim Plaintiff).
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. On July 26, 1996, the Plaintiff purchased 114.5 square meters of a brick sloping roof house 114.5 square meters on the land from D, E, and F (hereinafter “the Plaintiff’s land”). On July 30, 1996, the Plaintiff completed the registration of ownership transfer for each of the above real estate on July 30, 1996.
B. On November 24, 1980, G completed the registration of preservation of ownership on H large 965 square meters (hereinafter “Defendant’s land”) adjacent to the Plaintiff’s land in this case and owned it. On June 11, 2003, G sold the above land to the Defendant, and completed the registration of transfer of ownership on June 18, 2003. On June 18, 2004, G sold 33.06 square meters of a wooden village house and 19.83 square meters of a wooden village house (hereinafter “Defendant’s house”) located on the Defendant’s land in this case, and completed the registration of transfer of ownership on June 19, 204. However, Defendant’s housing in this case is a building that obtained approval of use from the competent administrative agency on October 10, 194.
다. 이 사건 피고 주택의 스레트 처마 일부(이하 ‘이 사건 처마’라 한다)는 이 사건 원고 토지 중 별지 감정도 표시 15, 16, 31, 15의 각 점을 차례로 연결한 선내 ㈃ 부분 2㎡[이하 ‘이 사건 원고 토지 중 ㈃ 부분’이라 한다] 위에 설치되어 있고, 이 사건 피고 주택의 신축 중인 부속건물에 해당하는 벽돌 외벽(이하 ‘이 사건 벽돌 외벽’이라 한다)은 이 사건 원고 토지 중 별지 감정도 표시 14, 15, 31, 16, 17, 18, 19, 20, 14의 각 점을 차례로 연결한 선내 ㈂ 부분 14㎡[이하 ‘이 사건 원고 토지 중 ㈂ 부분’이라 한다] 위에 설치되어 있으며, 이 사건 원고 토지 중 별지 감정도 표시 2, 30, 29, 28, 27, 26, 25, 24, 23, 22, 21의 각 점을 차례로 연결한 선 위에 있는 옹벽 및 담장 이하 '이...
