The judgment below

Examining the reasoning in light of the evidence, the lower court reversed the first instance judgment that acquitted the Defendant on the charge of violating the Act on the Aggravated Punishment, etc. of Specific Crimes among the facts charged in the instant case and sentenced the Defendant guilty.

Examining the relevant legal principles and evidence, the lower judgment did not err by misapprehending the legal doctrine on the duty of care and the interpretation of the relationship with the driver, contrary to what is alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
