Defendant shall be punished by a fine of KRW 2,500,000.
When the defendant does not pay the above fine, 100,000 won.
Punishment of the crime
The Defendant, as the representative director D, exercised the right of retention on the construction site of the Jeonnam-gun apartment new construction site. However, around June 21, 2012, the victim G, the FF representative director of the Seoul District Court, occupied and managed the above site by obtaining a provisional disposition order for evacuation of the above construction site from the Gwangju District Court, and did not go through legal procedures, such as making a judgment that his/her right of retention was unduly deprived, and without going through legal procedures, he/she tried to identify the service employees of F, a service company, who were security guards of H, J, K, L, and M, who operated the service company, and occupied the above site and occupy the site.
1. On October 14, 2012, the Defendant: (a) instructed N,O, P, and Q, R, S, T, etc., an employee of the service company, to “bridge off” at the entrance of the Y, I, J, K, L, L, M, and D’s employees at the construction site of the Y, Young-gun, Yong-gun, Yong-gun, Nam, Inc. Around October 14, 2012; (b) H and I, using a bridge, entered the entrance beyond the pents of the above construction site; (c) opened the entrance to the entrance; and (d) continuously, the Defendant moved to the 2nd floor office of the commercial building used by the head of the team in charge of the above construction site management to the office office; and (e) continued to enter the wall board by removing the Y, I, K, and L from the wall board; and (e) continued to enter the 1st floor office of M to the above 1st floor.
Accordingly, the defendant intruded into the E apartment construction site and commercial buildings, which are structures managed by the victim, jointly with H, I, J, K, L, M.
2. The defendant is in violation of the Punishment of Violences, etc. Act (joint destruction and damage).
The date, time, place, H, I, K, L, M, and J as well as D employees of N,O, P, and service companies, Q, R, S, T, etc., “ beyond the entrance and exit doors.”
