On October 24, 2018, at around 17:30 on October 24, 2018, the Defendant: (a) in the “C Real Estate” located in Gwanak-gu, Seoul Special Metropolitan City, caused the victim’s face face to be assessed; and (b) caused the victim’s head, who was used on the floor, was taken several times, to be in an obscure state due to the victim’s hard-to-face-to-face-to-face-to-face-to-face-to-face-to-face transfusion, and so forth.

Accordingly, the defendant carried dangerous objects and inflicted bodily injury on the victim, thereby causing danger to the victim's life.

Summary of Evidence

The Defendant’s assertion of the Defendant and his defense counsel under Articles 258-2(2) and 258(1) of the relevant Criminal Act concerning criminal facts alleged that the Defendant had a weak mental and physical disorder by making a statement that he had no memory at the time of the instant crime. However, in light of the following circumstances acknowledged by each of the evidence, namely, the Defendant made a relatively detailed statement from the investigative agency to the day immediately before the instant crime, and immediately after the instant crime, the witness made a statement to the point that he was interested in the Defendant under the influence of a little alcohol, the Defendant was in a state that he had the ability to discern things or make decisions at the time of the instant crime.

Therefore, the above argument is rejected.

The reason for sentencing [Scope of Recommendation] Special Bodi Injury and Cumulative Assault. No basic area (one year to June, three years and six months) (the person subject to special sentencing) (the person subject to special sentencing) is recognized by the defendant himself/herself for the crime of this case.
