Article 208(3)1 of the Civil Procedure Act and the main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings for the Dismissal Part (Judgment without Oral Proceedings) was amended, and the relevant interest rate was changed from 15% per annum to 12% per annum, and Article 2 of the Addenda (No. 21, 2019) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings provides that “The statutory interest rate for cases in which the first instance trial is pending in a court at the time of enforcement of this Decree shall be governed by the previous provisions for the portion arising before May 31, 2019, and the statutory interest rate for cases arising after June 1, 2019 shall be governed by the amended provisions of this Decree.”

Therefore, 15% per annum from February 8, 2019 to May 31, 2019, which is the day following the delivery of a copy of the complaint of this case, and 12% per annum from the following day ( June 1, 2019) to the day of full payment.

Therefore, the part exceeding the damages for delay claimed by the Plaintiff is without merit.
