1. On May 23, 2015, Defendant A assaulted the victim at one time on the front side of the “H” way, which is a building of the newly constructed commercial parking lot G G, Nam-gu Incheon Metropolitan City, on the ground that the time of this promise has been delayed, on the ground that the victim B (S 41) was late.

2. 피고인 B 공소사실 중 피고인 B이 피해자 A과 몸싸움을 하였다는 부분은 A에게 인정된 범죄사실에 비추어 이를 삭제하였다( 그 내용의 유무가 피고인의 범죄 성부에 영향을 주는 것은 아니고 피고인의 방어권 행사에 장애가 있는 것도 아니므로 별도의 공소장 변경 없이 삭제하였다). 피고인은 제 1 항 기재 일시, 장소에서, 제 1 항의 기재와 같이 피해자 A(47 세 )으로부터 뺨을 맞게 되자 이에 화가 나 피해자에게 달려들어 양 주먹으로 피해자의 얼굴을 3회 때리고, 오른손으로 피해자의 왼팔 부분 옷을 잡고 뿌리쳐 피해자로 하여금 넘어지면서 오른쪽 가슴 부분이 바닥에 부딪히게 하였고, 이후 쓰러져 있는 피해자의 가슴 및 어깨 부위를 발로 수회 짓밟고 걷어찼다.
