2. Defendant B shall be punished by imprisonment for six months.

Defendant

A is a person operating the “E Agricultural Partnership”; Defendant B is a person who is the representative of “F” (the birth of the foregoing A); “A” the representative of “H”’s employee of the E Agriculture Comprehensive Corporation (the wife of the above A); “E is the representative of “J”; “E is the former employee of the E Agricultural Partnership; “K is the former employee of “N”; “E is the former employee of the E Agricultural Partnership; “M is the former employee of “N”; “O is the N” (the mother of the above A); “P is the former employee of “L” (the child of the above I); and Q is the former representative of “R”.

1. In the event that Defendant A, Defendant B, G, I, K, M,O, P, and Q jointly commits a joint crime, “EAT system” operated and managed by the Korea Agricultural and Fishery Food Distribution Corporation, and that the EAT system in relation to the supply of food materials participated in the electronic bidding related to the supply of food materials at the national site operated and managed by the Public Procurement Service, it shall not be allowed to lend the name of another company or to reflect the same public notice in duplicate.

Nevertheless, the Defendants conspired with G, I,K, M,O, P, and Q to increase the number of enterprises participating in an electronic tendering procedure for school meal service, and to establish a disguised company for the purpose of raising the successful bid rate for the electronic tendering procedure for the supply of school meal service materials, to establish a disguised company and to make a double bidding on the same bidding case as if they were the suppliers of school meal service materials separately operated from the “E agricultural partnership”. On April 2, 2014, the Defendants completed the registration of each “H” in the name of “J”, “F” in the name of Defendant B around April 8, 2014, and “N” in the name of “N”, “L” in the same name of P, and “L” on March 3, 2015, and Q around April 30, 2015.

Accordingly, on September 22, 2014, the Defendants “E Agricultural Partnership Office” located in S in Chungcheongnam-si, Chungcheongnam-do, and the “State head of the Party” managed by the Public Procurement Service is the joint purchase of school meal goods (Additional food) for the first and fourth school schools.
