1. The plaintiff's claim is dismissed.

2. The costs of the lawsuit, including the part resulting from the supplementary participation, are all assessed against the Plaintiff.

Reasons

1. Details of the decision on retrial;

A. The Plaintiff is a non-profit corporation that is established on November 11, 1974 and ordinarily employs approximately thirty workers and engages in the business stipulated in Article 39 of the Credit Unions Act (hereinafter “New Cooperatives Act”).

The supplementary intervenor of the plaintiff is a non-profit corporation that is established under Article 61 of the New Cooperatives Act and is engaged in the activities specified in Article 78.

B. The Intervenor joining the Defendant concluded a labor contract with the Plaintiff and worked in the Plaintiff.

C. From January 7, 2016 to August 8 of the same month, and from January 18, 2018 to February 22, 2015, the Plaintiff’s Intervenor conducted a regular inspection and sector inspection on the business affairs of the Plaintiff during the business year of 2015, and thereafter, Article 20(6) of the former Guidelines for Standard Operation of Credit Union (amended by Act No. 1450, Jul. 27, 2016) of Chapter III of the Code of Ethics of Officers and Employees of Credit Union; Articles 17 and 19 of the Guidelines for Ethical Action of Credit Union; Article 14(7)

The defendant joining the defendant who violated B was required to take disciplinary action against the defendant joining the defendant who violated D.

After going through the Disciplinary Committee on June 14, 2016, the Plaintiff was subject to disciplinary action as listed below against the Intervenor joining the Defendant on June 15, 2016.

(hereinafter referred to as "the disciplinary action of this case"). The period during which private loans are made between the employees who are subject to disciplinary action B: from June 18, 2007 to August 6, 2015: 1,103,000 won (7 items) from five employees; 3,070 won (5 items) have been transferred to three employees; 1,070 won has been suspended from office in January 25, 2005 to November 25, 2015; 23,250,000 won (43 items) have been borrowed from ten employees; 1,584,000 won has been transferred to six employees; 2,000 won has been transferred to three employees; 1,584 won has been transferred to 3,00 won to 6 employees; 2,000 won has been transferred to 10 million won to 10,000 won through 22,00 won.
