The plaintiff indicating the claim is the creditor who established the right to collateral security on the D brick structure and the two-story row housing in the city of the government owned by Eul. On September 12, 1982, E entered into a promise with F for sale and purchase of shares of F 1/14 square meters out of F 1/14 square meters in the city of Jung-si, the Government Office of the District Court on September 13, 1982, and completed the registration of the right to claim transfer of shares as of September 13, 1982. However, the right to complete the pre-sale agreement based on the above pre-sale agreement was transferred to B, which is the ownership of the above land. Since E also died on or around July 1993, the right to complete the pre-sale agreement based on the pre-sale agreement became extinct with the exclusion period of 10 years. Thus, Article 208(2)37(1) of the former Civil Procedure Act and Article 257(2)1(3) of the plaintiff's separate heir of the provisional registration by subrogation of Eul.
