A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The Defendant is a person who is engaged in the international marriage brokerage business in Seo-gu, Gwangju.
The Defendant, while operating the said enterprise, prepared an international marriage brokerage contract with the Vietnamese women, and followed the procedures related to marriage brokerage after receiving the relevant expenses, while inducing the clients to enter the Vietnamese women through the marriage reporting procedure and visa issuance in order to promptly proceed with the procedures for the entry of the Vietnamese women through the marriage reporting procedure and visa issuance of the two countries related to international marriage, by deceiving the clients as soon as possible, and planned the clients to receive or receive the money under the pretext of bank balance certificate necessary for applying for visa issuance from the clients, or to use it for personal purposes.
1. On March 2012, the Defendant entered into an international marriage brokerage agreement on September 20, 201 and made a false statement to the victim F (59 years of age) who is leading to the procedure for filing a marriage report with Vietnam women (including June 1, 2012).
However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it.
On March 27, 2012, the Defendant, by deceiving the victim as such, received 5 million won from the victim to the account in the G name on the pretext of borrowing money from the victim.
2. On June 2012, the Defendant committed fraud against the victim H: (a) entered into an international marriage brokerage agreement on November 29, 201; and (b) after filing a marriage report on February 10, 201, pursuant to the visa application on February 10, 2012, the victim H (the age of 42) who is leading to the entry of Vietnam women through the visa application should keep up to the balance of the passbook to certify the bank balance of the inviter at the time of filing the visa application for the Vietnam women; and (c) promptly return the documents required for the visa application after the completion of the visa application procedure.
