The prosecution of this case is dismissed.

Reasons

The facts charged in the instant case are that the Defendant, at around 04:00 on January 9, 2015, c 'C' in Gangnam-gu Seoul Metropolitan Government around 04:00, assaulted the victim at once by drinking, on the ground that the Defendant fell against the victim D(30) and body.

This case may not be prosecuted against the express will of the victim.

In this regard, the victim D withdraws his wish to punish the defendant after the prosecution of this case was instituted.

Therefore, the public prosecution of this case is dismissed in accordance with Article 327 subparagraph 6 of the Criminal Procedure Act.
