A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Crimes on December 27, 2012
A. On December 27, 2012, the Defendant forged securities: (a) around December 27, 2012, a notary public, who is located in Gyeonggi-si, Gyeonggi-do, borrowed KRW 13 million from E from D office to “E return, KRW 13 million, KRW 13000, date of issuance: December 27, 2012; (b) March 28, 2013; and (c) the issuer: (a) affix a G seal on the G name of the Promissory Notes as stated “F 725, 2302 G”.
Accordingly, for the purpose of exercising, the Defendant forged a promissory note in the name of securities G.
B. The Defendant, at the above date, borrowed KRW 13 million from E at the above time, at the above place, and at the same time, he borrowed KRW 13 million from E, and “A (G) shall regularly borrow from B (E) the payment of the purchase price by March 28, 2013. In addition, if the payment was impossible due to failure to comply with the due date for performance, the sale right is transferred to B without any condition. From that date, the ownership of the sale right is deemed to have objection, and the ownership of the sale right is confirmed by the evidence, and was affixed with G seal on the G name of “A” stating “A”.
Accordingly, for the purpose of uttering, the Defendant forged a letter of confirmation in G name, which is a private document on rights and obligations.
C. The Defendant, at the same time and place as above, exercised a forged promissory note and a written confirmation as if it were a document duly formed.
2. Crimes on December 28, 2012;
A. On December 28, 2012, the Defendant forged private documents: (a) reversed a monthly rent contract (2.50,000 won per month in the security deposit10,000 won) with I under the joint name of the Defendant and G at H C 203, Namyang-si, Gyeonggi-do around December 28, 2012; (b) and (c) in the column for the location of the “real estate lease contract” in the column for the location of the “real estate lease contract”.
