1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Basic Facts
On January 9, 2002, Defendant E (F before the opening of the name) entered into a sales contract with the Dongjak-gu Seoul Metropolitan Government H large 331 square meters (hereinafter “instant real estate”) to purchase the 595 square meters (hereinafter “instant 2 real estate”) between G and G on January 9, 2002, and completed the registration of ownership transfer in the name of the Plaintiff for the instant real estate on March 27, 2002 and the name of the Defendant for the instant 2 real estate.
After that, on April 16, 2004, each registration of ownership transfer was completed in the name of the defendant on the ground of the gift contract dated April 13, 2004 with respect to the 1 and 2 real estate of this case.
On April 20, 2008, the Defendant sold the instant real estate to J, K, and L on April 20, 2008, and completed the registration of ownership transfer to the said purchaser on August 12, 2008.
On the other hand, on May 27, 2008, the Defendant purchased each of the buildings with 169 square meters and ground (hereinafter “instant three real estate”) in Yeongdeungpo-gu, Seoul, Seoul, and on June 10, 2008, N24.90 square meters and ground buildings (hereinafter “instant four real estate”) in Hanyang-gu, Jeonyang-gu, Jeonyang-gu, Seoul, and completed the registration of ownership transfer under the name of the Defendant around that time.
【The Plaintiff’s assertion by the parties concerned as to the purport of the whole pleadings and evidence Nos. 1 through 3 (including each number), 1, 7, and 8, and 1.6 billion won of the purchase fund of the instant 1 and 2, acquired the ownership of each of the instant real estate, and completed the registration of ownership transfer under the name of the Plaintiff as to the instant 1 and 2, and under the name of the Defendant’s representative as to the instant 2 real estate, each of the instant 1 and 2, after concluding a title trust agreement with the Defendant, completed the registration of ownership transfer under the name of the Defendant as to the instant 1 and 2, and completed the registration of ownership transfer as to the instant 3 and 4 real estate after selling the instant 3 and 4 real estate in around 208, by concluding a title trust agreement with the Defendant.
