1. The Defendants shall jointly and severally pay to the Plaintiff KRW 29,467,018 and the interest rate thereon from December 28, 2019 to the date of full payment.
The Plaintiff leased 24% interest rate of 50,00,000 won to Defendant C on May 16, 2019, and due date of repayment on August 16, 2019, and the fact that Defendant D guaranteed Defendant C’s debt to the Plaintiff by Defendant C does not dispute between the parties or can be recognized in accordance with the overall purport of entry and pleading. The Plaintiff received interest or delayed payment from the Defendants until December 27, 2019, and KRW 20,532,982 out of the principal amount.
Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff KRW 29,467,018 (=50,000,000 - KRW 20,532,982) and damages for delay calculated by the rate of 24% per annum from December 28, 2019 to the date of full payment.
The plaintiff's claim of this case is justified and accepted.
