The defendant shall be innocent.

Reasons

Indictment

1. On April 2019, the Defendant: (a) carried out a hole on the water pipe managed by the damaged person who was laid underground in the village in front of the building located in Kimcheon-si, Kimcheon-si, without obtaining approval from the Council of Council of the damaged person C (representative: D) and connected the greenhouse in which the Defendant resides with the Defendant by exposing the X-cell pipe.

Accordingly, the defendant damaged the irrigation channel to make the city defective repair cost.

2. As described in paragraph 1, the Defendant: (a) connected to the plastic house in which the Defendant resides by sticking the X-cell pipe on the water pipe managed by the victimized person; (b) used water from around that time to July 17, 2019, from around 09:50 to around 09:50.

Accordingly, the Defendant stolen the property owned by the victim.

Judgment

1. According to the evidence examined in this court of fact finding, the following facts can be acknowledged:

A. On 2009, Kimcheon-si opened the relevant small-scale water supply facilities (hereinafter “small-scale water supply facilities of this case”) by drawing groundwater through the care of the village in Kimcheon-si, Kimcheon-si, installing a water tank and connecting the water pipes to each household so that village residents can jointly use the water supply facilities, and delegated the management thereof to the representative of the C Council pursuant to the Ordinance on the Management of Small-Scale Water Supply Facilities and Small-Scale Water Supply Facilities in Kimcheon-si.

B. Meanwhile, the main contents of the Kimcheon-si Village Waterworks and the Small-Scale Water Supply Facilities Management Ordinance, which was partially amended and enforced from October 1, 2013, are as follows:

Article 2 (Definition of Terms) The definitions of terms used in this Ordinance shall be as follows:

2. The term "small-scale water supply facilities" means water supply facilities defined in subparagraph 14 of Article 3 of the Water Supply and Waterworks Installation Act;

3. The term "manager" means the representative of a consultative council representing employers in the relevant area for small-scale water supply facilities;
