A. A. On June 2015, the Defendant contracted the Plaintiff with the construction cost of KRW 54 million among the new construction works of the building located in Sejong-si B, and the Plaintiff completed the said construction work.

After that, the Defendant, among the new construction works of the building C located in Sejong City, contracted the construction cost of the steel construction to the Plaintiff as KRW 21,585,975, and the Plaintiff completed the said construction work.

B. However, the Defendant paid to the Plaintiff only KRW 45,00,000 among the total construction cost of KRW 75,585,975 (= KRW 54,00,000,000).

C. Therefore, the Defendant is obligated to pay to the Plaintiff the above construction balance amount of KRW 30,585,975 (i.e., KRW 75,585,975 - KRW 45,00,000) and damages for delay calculated at the rate of 15% per annum from September 21, 2016 to the day of full payment, which is the day following the delivery of a copy of the instant complaint.
