1. The Defendant’s respective money stated in the attached Form 1 claim amount to the Plaintiffs, and as to the money, from November 9, 2018 to May 31, 2019.

Reasons

Basic Facts

The N Co., Ltd. (hereinafter “N”) concluded a sales contract with the owners of the instant project site (including No. 1, No. 2, 2006) with a total of 401 units of regional housing association (hereinafter “instant project”) in order to carry out a new project of constructing apartment (hereinafter “instant project”). From May 31, 2006 to end of 2012, the N Co., Ltd. entered into a sales contract (hereinafter “N”) with the owners of the instant project site as shown in the following table:

The main contents of the sales contract for the instant project site concluded between the landowners listed in the table of this subsection are as follows.

1. Indication of real estate (Omission thereof);

2.In the sale of the above real estate in Article 1 of the terms of the contract, the buyer shall pay the purchase price as follows:

The total purchase price omitted (10%) amount omitted, 100% intermediate payment (%) at the time of a contract, 100% of land - omitting any balance (90%) amount, and the down payment after the confirmation of P.F shall be deposited with an individual passbook without passbook immediately after receipt of the agreement on the land ownership before the project area. The deposit becomes effective as a contract immediately after the deposit of the down payment.

Article 4 The seller shall deliver all documents necessary for the ownership (registration) to the buyer at the time of receipt of the balance, and shall actively cooperate with the registration of transfer.

The Defendant is a regional housing association established to carry out the instant project. On May 30, 2012, prior to the authorization of the establishment of the association, the Defendant is all “Defendant” without being classified under the name of “AZ regional housing association”.
