2. Defendant B shall be punished by a fine of KRW 1,00,000.

On February 13, 2018, at around 11:30 on February 13, 2018, Defendant A opened the victim E’s house located in Nam-gu Busan Metropolitan City, and the victim opened the crime prevention window on the left part of the entrance, and intrudes inside through the window, and cut off one of the pigs fats on the inner door, containing cash equivalent to KRW 60,000,000 from around the day to March 27, 2018. The Defendant invaded the victim’s residence on the victim’s house over five occasions in total, including the daily list of crimes, and carried out money and valuables equivalent to KRW 6,96,000 in total, such as cash and precious metals owned by the victims.

Ultimately, the Defendant invadedd the victims’ residence and stolen the victims’ property.

2. Defendant B is a person engaged in sales of precious metals with the trade name “G” from Busan GF.

At around 19:00 on March 2018, the Defendant purchased a pair of 1670,000 won in the market value of the victim H, which he stolen from A, (one black part, one chemical part, and one half of the chemical part) in the middle of 19:00,000.

In such cases, the person engaged in sales of precious metals has a duty of care to verify whether he/she is stolen by ascertaining the personal information, etc. of the seller, while taking into account the details of acquisition, motive for sale, and demand for the price suitable for the transaction price.

Nevertheless, the Defendant neglected to make a judgment on the stolen water and purchased a pair of 270,000 won in price by negligence, as long as he neglected to make a judgment on the stolen water.

Ultimately, the Defendant acquired stolen goods by occupational negligence as above.
