1. The Defendant indicated the Plaintiffs on the attached Form No. 2 of the first floor of the real estate indicated in the attached Form No. 996.44 square meters.
1. Facts of recognition;
가. 원고들은 대전 서구 D 지상 건물(이하 ‘이 사건 건물’이라고 한다)에 관하여 각 1/2 지분을 소유하고 있는바, 2003. 5. 11.경 피고와 이 사건 건물의 1층 제2종 근린생활시설 996.44 ㎡ 중 별지 도면 표시 ㈀, ㈁, ㈂, ㈃, ㈄, ㈅, ㈀의 각 점을 순차로 연결한 선내 부분(107호) 333.88㎡(이하 ‘이 사건 점포’라고 한다)를 임대차보증금 50,000,000원, 월 차임 6,000,000원(부가세 별도), 임대차기간 2003. 6.부터 2005. 6.까지로 정하여 임대하기로 하는 임대차계약을 체결하였고, 피고는 그 무렵부터 이 사건 점포에서 감자탕 가게를 운영하기 시작하였다.
B. Around June 11, 2007, the Plaintiffs concluded a lease agreement with the Defendant and the instant store at KRW 50,000,000, monthly rent of KRW 6,600,000 (Additional Tax) and the lease period from June 11, 2007 to June 10, 2009.
C. With respect to the instant store, around February 20, 2008, the Plaintiffs entered into a lease agreement between the Defendant and the monthly rent as above B, and the lessee entered into a lease agreement between E (the Defendant’s woman’s woman’s birth) and the lease period from February 20, 2008 to June 10, 2009. On June 8, 2009, the lease deposit, monthly rent, and the lessee entered into a lease agreement between June 11, 2008 and 24 months.
After that, on June 10, 201, the Plaintiffs concluded a lease agreement with the Defendant and the lease deposit amount of KRW 50,000,000 (in order to raise KRW 50,000,000 after six months), monthly rent of KRW 7,00,000 (in addition, separate tax), lessee E, or lease term of June 11, 201. On January 1, 2012, the Plaintiffs concluded a lease agreement with the Defendant and KRW 100,000,000 (Additional tax), monthly rent of KRW 7,00,000 (in addition), E, lease agreement from January 1, 201 to December 31, 2012 (hereinafter “instant lease”).
