1. The Defendant shall pay to the Plaintiff KRW 75,384,840 and the interest rate of KRW 12% per annum from July 3, 2019 to the day of complete payment.
Around February 2019, the Plaintiff received a contract from the Defendant for the construction of the new construction of the five-story housing unit in the 24th apartment house in the Jeonbuk-gun, Jeonbuk-gun (including an additional construction) and completed the said construction on or around February 2019. The fact that only KRW 20,000,000 among the construction cost of KRW 95,384,840 is not disputed between the parties or that only the Plaintiff received KRW 20,00,000 among the construction cost of KRW 95,384,840 may be recognized by taking into account
The Defendant is obligated to pay damages for delay at the rate of 12% per annum as stipulated in the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings, etc. from July 3, 2019 to the date of full payment, which the Plaintiff seeks, after completion of the construction cost unpaid to the Plaintiff (i.e., KRW 95,384,840 - KRW 20,000), and after completion of the construction cost.
