2. The costs of lawsuit shall be borne by the Plaintiff.

A. The Plaintiff is a reconstruction association established with the authorization of establishment on June 25, 2003 to implement the A apartment reconstruction project (hereinafter “instant apartment”) and its appurtenant welfare facilities (including incidental welfare facilities, when included) on the ground of 184,051.50 square meters in Busan Shipping Daegu District, Busan, the Plaintiff is a reconstruction association established with the authorization of establishment on June 25, 2003 to implement the instant apartment reconstruction project.

The Defendants are corporations established for the purpose of construction business, etc., and are contracted with the Plaintiff for the execution of the instant project.

B. On October 12, 2008, the Defendants, who entered into a contract, selected the Plaintiff as a joint executor of the instant project at the general meeting for the selection of the work executor. On February 24, 2009, the Plaintiff entered into a construction contract with the Defendants to newly construct the instant apartment, etc. (hereinafter “instant contract”).

The main contents are as follows:

Ⅰ A contract for construction works;

1. Name of the project: A apartment reconstruction project; and

2. Location of business: Busan Shipping Daegu and Foreign Institute.

3. Period: 46 months from the date of reporting on commencement.

6. 1) Total floor area of 517,640.64 square meters (156,586.29 square meters) (based on the design presented at the time of bidding): The number of households per unit of 2,369 square meters (5,687.59 square meters) 18,801 square meters (5,687.59 square meters), 517,640.64 square meters (156,586.29 square meters) below the ground of apartment 8 / 2,369 / 2,369 / 2,369 / residential buildings/ Residents' Self-Governing Province / Public Security Center / 18,801 square meters (5,687.59 square meters): The scale of construction for 101 square meters per unit of 2,165 / 103 household shall be determined in accordance with the changed drawings at the time of subsequent modification.

8. Method of payment of construction contract amount: under general conditions of construction contract;

9. Shares in the Corporation: 45% of the Defendant Hyundai Construction Co., Ltd., 45% of the Defendant Kusan Construction Co., Ltd, and 10% of the Defendant Hodong Construction Co., Ltd.
