Reasons

According to the records of this case, D, the Defendant’s overall transfer, filed a lawsuit against the Plaintiff for the payment of the purchase price under the Macheon-si District Court Decision 2007Gaso10438, which is the Ma-si District Court 2007Gaso10438, and the above decision of performance recommendation became final and conclusive on July 11, 2007. Thus, in this case where there is no defendant’s assertion and proof as to the suspension of the extinctive prescription of the claim established by the above decision of performance recommendation, the claim is deemed to have been completed and extinguished as of the expiration of ten years after the above final and conclusive date. Thus, the plaintiff’s claim of this case seeking the exclusion of the enforcement power of the above decision of performance recommendation is with merit,
