A. The plaintiff set the interest rate of KRW 10,00,000 on April 2, 2003 to the defendant, KRW 20,000 on December 30, 2003, and KRW 20,000 on May 9, 2003 to determine the interest rate of KRW 1%, the due date of repayment of KRW 10,000 on March 30, 2004, and KRW 10,000 on August 30, 200 and the due date of payment of KRW 30,00 on December 30, 203 respectively.

B. The Plaintiff filed a payment order against the Defendant with the Changwon District Court Jinju Branch 2006Ka4055, and received a payment order from the said court that “the Defendant jointly and severally with C to the Plaintiff 40,000,000 won and the amount equivalent to 12% per annum from July 10, 2005 to September 13, 2006, and 20% per annum from the next day to the day of full payment.” The above payment order was finalized on September 28, 2006.

C. However, since the defendant does not pay the remainder of the principal amount of KRW 10,000,000 among the obligations under the above payment order, the defendant shall pay the remainder of KRW 30,000,000 to the plaintiff and delay damages therefor.
