2. The costs of lawsuit shall be borne by the Plaintiff.

A. The Plaintiff is an organization established for the purpose of developing the A market and revitalizing the business district located in the L in Sejong-si.

B. Of the above A market buildings (hereinafter “instant building”), the part of the 1st floor is divided into 156 units.

C. Of the instant buildings, the second floor is opened and operated by 10 households in total.

All of the 10 stores that operated the furniture on the second floor of the instant building were tenants, but on July 3, 2018, the second floor of the instant building was Defendant E (100/100), Defendant D (100/100), M (100/100), N (the spouse of Defendant K, 100/100),O (10/100), P (the spouse of Defendant F, 200/100), and Q (30/100).

The Defendants are operating furnitures on the second floor of the instant building.

The Plaintiff’s articles of incorporation stipulate the following qualifications for membership.

Section 8(1) The regular members of the merchants' association shall be the merchants who are registered as business in the A market and are directly engaged in the business (including lessees).(2) The associate members of the merchants' association shall not own the stores in the A market and engage in the business directly, but shall be the associate members if they are admitted to the merchants' association.

(3) The members of the merchants' meeting shall be limited to the 156 commercial buildings of the first floor, 156 commercial buildings, and 2 underground and second floor are registered as members at the merchants' meeting with business registration and shall be limited to those who have obtained approval from the board of directors. (4) The members of the merchants' meeting shall agree to the purpose of the establishment, prepare a prescribed application for membership, and submit to the Secretariat. (4) The names and trade names of the members of the secretariat shall be limited to those registered in the list of members (the last part of the articles of incorporation shall be attached to the list of members).
