1. 상해 피고인은 2012. 7. 9. 19:05경 부산 사하구 B 앞 노상에서 구청에서 실시한 배수로 공사와 관련하여 ‘구청에서 길을 뭐 이따위로 해놨냐’고 이야기 하였을 때 피해자 C(여, 68세)가 ‘아저씨가 왜 그런 것을 신경 쓰느냐.’고 나무라자 이에 화가 나 주먹으로 피해자의 얼굴을 수회 때리고 머리카락을 잡아당기는 등으로 폭행하여 피해자에게 약 7일간의 치료가 필요한 안면부 및 두부의 타박상을 가하였다.

2. Around July 18, 2012, the Defendant drafted a false complaint with respect to C at the public service center of the private police station located in Pyeongtaek-dong, Busan, Seoyeong-dong, 569-1.

그 고소장은 “C가 2012. 7. 9.경 피고인을 폭행하여 피고인에게 약 3주간의 치료가 필요한 늑골 염좌 및 긴장의 상해를 가하고, ‘야이 개새끼야 니가 뭘 안다고’라고 욕을 하여 피고인을 모욕하였다”는 내용이었다.

However, in fact C was unilaterally assaulted by the defendant, and did not commit an assault or desire to commit an offense against the defendant.

Nevertheless, on July 18, 2012, the defendant submitted the above written complaint to the personnel of the public service center of the above police station.

As a result, the defendant was arrested for the purpose of having C receive criminal punishment.
