1. The Defendant’s KRW 170,539,482 as well as the Plaintiff’s KRW 6% per annum from March 1, 2018 to June 11, 2019.
The Plaintiff is a corporation that runs the sales business of livestock products, etc.; the Defendant is a corporation that runs the wholesale and retail business of livestock products; the Plaintiff sold meat equivalent to KRW 765,018,482 from November 17, 2017 to February 28, 2018; and the Defendant paid KRW 594,479,000 to the Defendant out of the sales proceeds of the said meat; or there is no dispute between the parties, or the Defendant paid KRW 594,479,00 among the sales proceeds of the said meat, and the purport of the entire pleadings is recognized by taking into account each of the items in Gap evidence 1 through 7, Eul evidence 1, and 2 (including each number).
Therefore, the Defendant is obligated to pay to the Plaintiff the remainder of KRW 170,539,482 (i.e., KRW 765,018,482 - KRW 594,479,000) and damages for delay calculated at the rate of 6% per annum under the Commercial Act from March 1, 2018 to June 11, 2019, which is the delivery date of a copy of the complaint of this case, and from the next day to the day of full payment, 12% per annum under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings.
Therefore, the plaintiff's claim is reasonable, and it is decided as per Disposition.
