2. Determination
A. The Defendant asserted the same purport as the grounds for appeal in the lower court, but the lower court, in light of the circumstances in its holding, determined that the Defendant’s act did not meet the requirements for a justifiable act, and that it is difficult to view that the Defendant was delegated by the authorized administrator of facilities to have performed the act of removing the notice in this case, and recognized
B. We affirm the judgment of the court below that recognized the crime of causing property damage in addition to the following facts: (a) the notice of this case removed by the defendant was a master related to the church training association, which did not contain any harm to another person’s reputation, insulting contents, false facts, or maliciously slandering a specific person; (b) it is hard to deem that it was difficult to remove it due to the necessity of urgent removal or the need for management authority; (c) the confirmation letter of the public relations team manager submitted by the defendant is merely a legitimate removal of the notice in violation of the guidelines; (c) it cannot be evidence supporting the fact that the defendant entrusted the authority to manage and remove the notice; and (3) the defendant was removed by removing the notice of this case by hand, and thus the defendant could not be used again; and therefore, (c) it is sufficiently recognized that the intent of causing property damage and damage was harmful to the usefulness of the posters.
