On November 4, 2010, the Defendant completed the registration of initial ownership relating to the building listed in the separate sheet (hereinafter “instant building”).
나. 원고는 2012. 2. 24. 공인중개사 C의 중개로 피고의 대리인 D와 원고가 피고로부터 이 사건 건물의 5층 중 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 순차 연결한 선내 부분 16.52m2(제505호)를 임대보증금 60,000,000원, 임대기간 2012. 3. 7.부터 2014. 3. 6.까지로 정하여 임차하는 내용의 임대계약을 체결하였다
(hereinafter referred to as “the lease of this case” and the above leased part (hereinafter referred to as “the building of this case”). C.
On February 24, 2012, KRW 3,00,000, out of the lease deposit of the instant lease, the Plaintiff transferred KRW 9,000,000 to the bank account in the name of the Defendant on March 7, 2012, and paid KRW 45,00,000,00 to D on March 7, 2012, and around March 7, 2012, the Plaintiff occupied the instant building 505.
On February 5, 2014, the Plaintiff notified the Defendant of the refusal to renew the lease of this case.
2. Comprehensively taking account of the assertion and the above-mentioned facts, the lease of this case was terminated on March 6, 2014. Therefore, the Defendant, a lessor, is obliged to pay the Plaintiff KRW 60,000,000, as well as to deliver the instant building 505, which is the object of lease, from the Plaintiff, as the lessee.
As to this, the defendant asserts that D did not grant D the right of representation for the lease of the building of this case, and therefore D does not have the effect of the lease of this case which D entered into on behalf of the defendant, but as seen above, part of the lease deposit of this case is the defendant.
