1. The Defendant’s KRW 70,000,000 as well as its annual 5% from July 31, 2012 to May 21, 2015 to the Plaintiff.
In full view of the facts stated in subparagraph 1 and the purport of the whole pleadings, the Plaintiff may recognize the fact that the Plaintiff lent KRW 70,000,000 to the Defendant on January 8, 2012, without interest agreement, as the due date for payment was set on July 30, 2012.
Therefore, the defendant is obligated to pay to the plaintiff 70,000,000 won with 5% per annum as stipulated by the Civil Act from July 31, 2012, which is the day following the above payment period, to May 21, 2015, the service date of the original copy of the payment order of this case, and 20% per annum as stipulated by the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment. Thus, the plaintiff's claim of this case is justified, and it is so decided as per Disposition.
