A. The Plaintiff is an insurer who has entered into a motor vehicle mutual aid contract with the owner of the cargo vehicle, etc., and the Defendant A is the owner and driver of the vehicle B (hereinafter referred to as “one vehicle”). The Defendant Eastern Fire Marine Insurance Co., Ltd. is the insurer who entered into a comprehensive motor vehicle insurance contract with the Defendant A.

B. The circumstances leading up to the occurrence of a traffic accident are as follows: (a) Defendant A driven one vehicle on December 21, 2012 at around 07:40, and passed at the 57 KK point in Ulsan-gun, Ulsan-gun, Seoul-do, Seoul-do, and stopped after the collision of road facilities, while snow ice ices caused by snow; and (b) Defendant A stopped only two vehicles following one vehicle (hereinafter referred to as “two vehicles”).

3) 또한 F 차량은 3차량을 따라 1차선을 진행하고 있었다. 4) 이러한 상황에서 소외 G은 H차량(이하 이 사건 사고차량이라고만 한다.)을 운전하여 이 사건 사고지점 부근 2차로를 따라 진행하면서 2차선에 정차해 있던 1,2차량을 발견하고 충돌을 피하기 위하여 1차선으로 차선변경을 하던 중 1차선에서 주행하고 있던 위 F 차량을 충돌하였고, 그 충격으로 위 F 차량이 튕기면서 앞서 진행하던 3차량을 추돌하였으며, 3차량은 그 충격으로 선행사고로 정지해 있던 2차량을 충돌하는 사고(이하 이 사건 사고라고만 한다.)가 발생하였다.
