The prosecutor's appeal is dismissed.
1. The lower court rendered a judgment dismissing public prosecution as to the violation of the Labor Standards Act and the Guarantee of Workers' Retirement Benefits Act among the facts charged in the instant case, and convicted the remainder of the facts charged.
However, since the prosecutor appealed against the guilty portion of the judgment of the court below and the dismissal of the above dismissal of the public prosecution is confirmed separately, the scope of this court's judgment is limited to the guilty portion
2. The summary of the grounds for appeal (e.g., e., e. dubity) of the original judgment (e. 3 million won) is too unhued and unreasonable.
3. The lower court’s judgment, as stated in its detailed reasoning, determined a punishment by fully taking into account the circumstances surrounding the sentencing of the Defendant as well as the overall circumstances surrounding the sentencing of the Defendant, is deemed to exist within a reasonable scope, and there are no circumstances to be newly considered in the trial. Therefore, it is not recognized that the lower court’s punishment is too uneasible and unreasonable.
4. The appeal by the prosecutor of the conclusion is groundless, and it is dismissed in accordance with Article 364(4) of the Criminal Procedure Act. It is so decided as per Disposition.
