Since then there is no significant change in circumstances to consider the sentencing of defendants.
Taking into account the petition of appeal, statement of reasons for appeal, and other various sentencing factors indicated in the records of trial submitted by the defendant and the prosecutor, the circumstances alleged by the defendant and the prosecutor are considered, and thus, it cannot be deemed unfair because the court below’s punishment is heavy or unhued.
Therefore, in accordance with Article 364(5) of the Criminal Procedure Act, all appeals filed by the defendant and the prosecutor without oral proceedings are dismissed.
