A defendant shall be punished by imprisonment for three years.
Punishment of the crime
[criminal history] On April 21, 2016, the Defendant was sentenced to three years of imprisonment with labor for a violation of the Personal Information Protection Act at the Busan District Court, and on April 29, 2016, the said judgment became final and conclusive on April 29, 2016, and is currently in the enforcement of the said sentence
[2] The Defendant: (a) conspireds to commit so-called "scaming" as a telephone financial company in Thailand to a Korean national as the team leader of the Boscing Call Center; (b) the Defendant and his accomplice did not have the intent or ability to open a bank loan passbook with low interest rates from the beginning; or (c) convert a loan from a bank at low interest rates into a low interest rate; (b) the Defendant and his accomplice did not receive a loan from a bank at low interest rates due to low credit rates; or (c) obtained a loan at a high interest rate in the second financial zone to the victims in economic old age at a low interest rate; and (d) make a false loan to establish a bank loan passbook at a low interest rate and make it used for the best transaction to enhance credit rating by making it available for the transaction to increase credit rating, such as the C, D, E, F, G, H, I, J, K, etc.; and (d) use it as a so-called "scam loan, etc. under the name of the victims."
After inducing a loan application by falsehood, the loan was remitted to the above "Spoot passbook" prepared by the person, and the name and role of the employee of the national bank who will misrepresent himself/herself was shared.
In collusion with C, E, G, I, J, K, etc. on July 14, 2014, the Defendant sent to the victim L with a high interest rate loan from No. 2 to the bank N(J) of the National Bank by misrepresenting the victim L with a M number and misrepresenting him/her in collusion with C, E, G, I, J, and K, if he/she calls to the victim L with a high interest rate of loan, he/she makes the victim make a false statement to be converted to a low interest rate loan.
