However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

1. On January 11, 2014, the Defendant violated the Road Traffic Act (refluence of measurement) around 02:47, the Defendant: (a) stopped on the two-lanes at the entrance of the D School located in Sincho-si C; (b) refused a police officer G belonging to the F District Unit of the Seocho Police Station F District, in receipt of a report, to demand a measurement using a drinking reduction device; and (c) took a bath to the police officer on the same day; (d) arrested the police officer in the act of committing an act of committing an offense and was transferred to the F District of the Seocho Police Station located in Sinsi-si.

The Defendant, from 03:17 to 04:07 on the same day, was required to comply with the request for a drinking test by inserting the breath in a drinking measuring instrument three times through a breathm for which there exist reasonable grounds to recognize that the Defendant was driven under the influence of alcohol by smelling alcohol from the above G within the said F Zone, breath, and breathm, etc., and thus, failed to comply with the request without justifiable grounds.

2. 모욕 피고인은 2014. 1. 11. 02:56경 제1항 기재 D학교 입구 도로 상에서 음주감지기를 통한 음주측정을 요구하는 속초경찰서 F지구대 소속 경찰관인 피해자 G, 같은 피해자 I에게, 동료경찰관 J, K가 듣고 있는 가운데, “야 씹새끼들, 난 그냥 주차해 두고 잠을 잔 것뿐인데 왜 지랄들이야!”라는 등 욕설을 하고, 계속하여 같은 날 03:17경부터 05:10경까지 위 F지구대 사무실 내에서 벽에 대변을 묻히는 등 행패를 부리면서 피해자들에게, L과 동료 경찰관들이 듣고 있는 가운데, “야, 이 씹새끼들아. 화장실도 못 가게 하냐. 나 바지에 똥 쌌다, 이 개새끼들아. 너희들 얼마나 받아 처먹었어, 너희들 이제 다 죽었어. 수갑 풀어, 좆같은 개새끼들아!”라는 등 계속 욕설을 퍼부어 공연히 피해자들을 각각 모욕하였다.
