The prosecution of this case is dismissed.
Reasons
1. Around 22:00 on February 13, 2019, the Defendant: (a) reported that female-friendly D, who drinks alcohol together with the victim E (the age of 29) in Gwangju-dong-gu, would drink alcohol; and (b) made an assault on the victim’s face and clothes, such as spitation, etc.
2. Determination
(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.
C. The expression of intent that the victim E does not want punishment on April 12, 2019
(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
