The defendant's appeal is dismissed.
1. The summary of the grounds for appeal had been arbitrarily prepared by the Defendant on March 14, 2013 in accordance with C’s instruction (hereinafter “instant advertising agency contract”). However, the Defendant forged the advertising production agency contract (hereinafter “instant advertising production agency contract”) on February 26, 2013 and the agreement dated April 29, 2013 (hereinafter “instant agreement”), and the lower court found the Defendant guilty of this part of the facts charged on the ground that the Defendant did not use the forged instant agreement.
2. In full view of the following circumstances acknowledged by the evidence duly adopted and examined by the court below, the defendant's assertion of mistake of facts is without merit, since the defendant may forge the advertising production agency contract of this case and the advertising agency contract of this case as stated in the facts constituting the crime in the judgment below, forge the agreement of this case, and use the forged agreement to C.
C consistently stated, from the investigative agency of Seoul Western District Court 2014Kahap145 case (hereinafter “related case”) to the above court, “The Defendant had consistently expressed that it was how to operate a business of investing Niber Advertising block investment to the Defendant around March 2013, and that the Defendant had presented an application for NAV advertising as of March 17, 2013.” The court of the lower court stated in the instant case that “the Defendant had presented the instant advertising agency contract and the advertising production agency contract at the time when the Defendant presented the application for NAV advertising. The Defendant granted a part of the principal and revenue of the money invested until the end of May 2013, and demanded the payment in late time without giving money, and agreed to extend the advertising period by November 30, 2013.”
