C. On June 15, 2017, the examiner of the Korean Intellectual Property Office (1) stated that the trademark applied for registration of this case is identical or similar to the mark of the pre-registered trademark and designated goods are identical or similar to those of the pre-registered trademark, and thus, the former Trademark Act (Amended by Act No. 14033, Feb. 29, 2016; hereinafter the same applies).

(2) The Plaintiff’s refusal decision was made to the effect that the Plaintiff cannot obtain registration because it falls under Article 7(1)7. The Plaintiff’s objection thereto was made before the Intellectual Property Tribunal.
