(2) Article 208(3)2 of the Civil Procedure Act applies mutatis mutandis to the applicable provisions of the Act only to the purport that the original copy of the payment order is served and the defendant is dissatisfied with the said payment order. However, the creditor was not present on the date of pleading and was not present on the date of pleading, and thus, the plaintiff’s assertion is deemed to have been led to a confession under Article 150(3) and (1) of the Civil Procedure Act (see, e.g., Supreme Court Decisions 208(3)2, supra.
