Reasons
1. The summary of the facts charged was around 20:10 on November 207, 2002, A, an employee, had B truck operate B truck with the gross weight of 40 tons exceeding 4.6 tons on the national highways of 31 degrees Gyeong-ri, Gyeong-ri, Gyeong-ri, Gyeongcheon-do.
2. Determination of the Constitutional Court on Article 86 of the former Road Act (amended by Act No. 4920 of Jan. 5, 1995, and amended by Act No. 7832 of Dec. 30, 2005, hereinafter “former Road Act”), Constitutional Court Decision 2010Hun-Ga14, 15, 21, 27, 35, 38, 44, 70 (merged) Decided October 28, 2010, is not guilty.
