1. The Defendant: (a) from April 2, 2015 to April 2, 2015, to Plaintiff A, KRW 22,920,02 and each of the said amounts.

Reasons

1. Facts of recognition;

A. The Defendant is a project executor of the Daejeon Seo-gu, Seo-gu, D, E, U.S. F, G, H, I, J, K, and L. Housing Site Development Project (hereinafter “instant project”).

The approval date of the development plan of the project of this case is December 16, 2003.

B. The Defendant, as the instant project, intended to specially supply migrantss' housing sites to be developed within the instant project district, as relocation measures for those who lose their means of living due to expropriation of their owned housing units or land, etc.

Accordingly, the defendant concluded a sales contract with the defendant on June 23, 2008 on the housing site of migrants. On June 23, 2008, the plaintiff A entered into a sales contract with the defendant for the 285.3m2m2 in Seo-gu, Daejeon, Daejeon, and the plaintiff B succeeded to the rights and duties under the sales contract from P who entered into the sales contract with the defendant on June 25, 2008 on the 29m2m2 in Seo-gu, Daejeon.

(hereinafter the above sales contract is referred to as "each sales contract of this case").

원고들은 이 사건 각 분양계약에 따라 피고에게 별지 계산표의 ‘⑨완납일’란 기재 각 해당일까지 ‘①정산분양대금’란 기재 각 해당 금원을 지급하였는데, 그 각 금원을 분납하는 경우 그 할부금에 대하여 일정액의 이자를 추가로 지급하고, 약정 납부기한을 도과하여 납부한 경우에는 지연손해금을 추가로 지급하였으며, 위 금원들의 합계액은 위 별지의 ‘⑤이자 및 지연손해금’란 기재 각 해당 금원이고, 한편 약정 납부기한보다 앞당겨 납부하는 경우에는 위 별지의 ‘⑥선납할인금’란 기재 각 해당 금원을 할인받았다. 라.

At the time of each sales contract, the Defendant calculated the sales price in accordance with Articles 16 and 17 of the Rules on the Establishment and Implementation of Relocation Measures by the Defendant (hereinafter referred to as the “Rules of this case”) and attached Table 2 by the following formula:
