Defendants 2 and C purchased precious metals with a forged credit card dried from H; Defendant A informed Defendant B and C with precious metal occupation; the role of Defendant B and C in keeping precious metal purchased at the nearby place during the process of purchasing precious metals; Defendant D took the precious metal out to China by drying it, and then disposed of it.

1. On April 28, 2017, the Defendants in violation of the Act on Financial Business Specializing in Fraud and Credit Business purchased one half of the total amount of KRW 300,00 from each victims of the following methods: (a) from the perspective of “K” operated by the victim J in Seopo-si on April 28, 2017; (b) presented the forged AMFN EXRES credit card (credit number L) to the victim as if they were issued genuinely; and (c) received one half of the same amount from the victims from the victim; and (d) then acquired goods, such as clothes, clothing, etc. in total of KRW 8,943,350 from each victims by the aforementioned method until 22:15 of the same day, and used the forged credit card.

2. Attempted fraud and violation of Acts of financial business specializing in credit finance;

A. On April 28, 2017, at around 15:54, the Defendants: (a) purchased one gold bling from “O” operated by the victim N in Jeju, and (b) presented the victim as if he/she was actually issued a forged credit card (credit number P) with payment of KRW 1,940,00,00, and used a forged credit card; (c) however, the Defendants’ behavior suspected of the Defendants’ behavior did not go against the intent that the victim would cancel the settlement approval on the same spot and not carry gold blling.
