Defendant:

A. The plaintiff (the selected party) and the sperm in the column of “excess work allowances” in the attached Form 1 sheet.

Reasons

1. Basic facts

A. The defendant is a public corporation established for the purpose of the business related to the development, etc. of petroleum resources. The plaintiff et al. was a worker belonging to the defendant or a retired worker, and was engaged in specific duties, such as the stockpile branch, construction site, and drilling.

B. The Defendant’s provision on remuneration and payment of various allowances and the written agreement on the introduction of a newness and compensation system between the Defendant and the Defendant’s trade union concluded on April 14, 2010 (hereinafter “instant agreement”) are as follows.

1) The definitions of terms used in Article 3 (Definition of Terms) of the Remuneration Regulations shall be as follows:

1. The term "basic annual salary" means the sum of a basic salary and a job-related salary;

(a) “Basic pay” means the remuneration of a nature of living corresponding to the class in question;

However, it shall be deemed that an overtime allowance (10 hours a month) is included in the overtime work.

(b) The term "job grade" means a differential remuneration paid by evaluating the value, difficulty, etc. of a duty;

2. The term "performance-based annual salary" means remuneration paid differently according to the results of evaluation of performance of duties of individuals and departments;

4. The term "basic annual salary" means an amount calculated by dividing the basic annual salary by 12;

6. The term "ordinary wages" means 75% of a monthly amount of basic annual salary as early remuneration for the calculation period of overtime working allowances;

Article 16 (Basic Annual Salaries) (1) The basic annual salary for employees shall be the amount calculated by aggregating the basic salary determined within the limits of the upper and lower limits of the amount for each class prescribed in attached Table 1 and the job classification wage according to the duty grade, and shall be paid monthly in 12 months.

(6) Duties wages shall apply to employees of Grade III or higher, and detailed standards therefor shall be determined separately by the president.

Article 17 (Additional Annual Salaries) For marine employees, etc., payment shall be made in addition to the specified ratio of the basic annual salary and a specified amount, and the standards for payment shall be as specified in attached Table 4.

Provided, That performance annual salaries and additional salaries shall be paid.
