Text
1. The Defendant’s payment order for the purchase price in Suwon District Court Decision 2012Hu698 (No. 2012) against the Plaintiff.
Reasons
1. The Plaintiff did not have purchased the goods alleged by the Defendant, and does not know whether the Defendant received the claim for the purchase price of the goods. There is a claim for the purchase price of household affairs.
Even if there was an application for a payment order on October 10, 2012 after three years since March 17, 2009, the due date for payment was completed.
Therefore, the enforcement of the payment order stated in paragraph (1) is excluded.
2. Judgment by constructive confession: Article 208 (3) 2 of the Civil Procedure Act.
