A. On January 31, 2013, the Plaintiff entered into a contract with Defendant B, a licensed real estate agent, to lease KRW 302 of the 3rd floor E-family house (hereinafter “instant building”) owned by C, which was set at KRW 70,00,000, and the lease period from March 5, 2013 to March 4, 2015 (hereinafter “instant lease contract”). The Plaintiff paid KRW 7,000,000 on the date of the contract, and paid KRW 63,00,000 on March 4, 2013, and completed the move-in report and the fixed date.

B. At the time of the conclusion of the instant lease agreement, the registration of the establishment of a right to lease on a deposit basis in F on June 7, 201 was completed, and the following lease parties were not registered, as the non-registered legal relationship: the registration of the establishment of a right to lease on a deposit basis in F on the first priority basis of the maximum debt amount of KRW 260,000,000,000, the registration of the establishment of a right to lease on a deposit basis under the name of F on the first priority of the maximum debt amount of KRW 65,000,000.

C. In the procedure of compulsory auction (Seoul District Court Branch Branch BranchK) applied by I, a lessee of the instant building 301, the instant building and the instant site were sold together, and the said auction court paid dividends to KRW 521,935,289 to the actual amount to be distributed as follows. The Plaintiff did not receive any dividend from the said auction procedure.
