The costs of appeal are assessed against the Plaintiff.

The lower court rejected the Plaintiff’s claim against the Defendant seeking payment of 60% of profits from sales of equipment based on the instant equipment supply contract for reasons indicated in its reasoning. Examining the relevant legal principles and records, the lower court’s reasoning was somewhat inappropriate, but its conclusion is justifiable. In so doing, contrary to what is alleged in the grounds of appeal, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence inconsistent with logical and empirical rules, or by misapprehending the legal doctrine on the interpretation

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
