A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. On January 9, 2009, the Defendant has a record of being sentenced to a fine of KRW 500,000 as a crime of violating the Road Traffic Act at the Daejeon District Court on January 9, 200, and a fine of KRW 2 million as a crime of violating the Road Traffic Act at the same court on November 24, 2009.
On July 11, 2013, the Defendant was under the influence of alcohol of 0.101% in blood alcohol concentration on July 11, 2013, and operated approximately 900 meters from the Daejeon Seo-dong, Seogu, Seo-gu, Daejeon. He driven a continental loan parking lot located in the Seo-gu, Seo-gu, Daejeon.
2. When the Defendant, as seen above, committed so-called a drunk driving, he had the remaining car name, which might be subject to aggravated punishment due to the same kind of power, etc. in the past, with the intention of driving the said C in the name of Dong C.
so,
A. On July 11, 2013, around 05:00, the Daejeon Western Police Station D District Office: (a) signed the “C” on July 11, 2013 at the driver’s name column at the bottom of the “Report on the Detection of a Alwing Drivers” to confirm that the blood alcohol content was controlled by 0.101% without authority for the purpose of exercising it at the D District Office of the Daejeon Western Police Station; and (b) marked a seal back to the name of the driver.
Accordingly, the Defendant forged the driver confirmation column in the report on detection of the driver in the above C name, which is a private document regarding the certification of facts.
B. On July 11, 2013, at the time and place stated in the preceding paragraph, the driver’s name column of the part stating “C” stating, “I will confirm that the above contents were identical to the facts, and if it is recognized as result of measurement and unfair, I will sign that I would not want to collect blood.” The driver’s name was signed “C” and stamped next to the name.
In this respect, the defendant, who is a private document on the certification of facts, is indicated in the report on the state of driving under the name of C.
